Definitions
Add-on: a secondary product that you may have in addition to your Membership. Special terms apply to Add-on products; (including but not limited to soft drinks, parking, paper backdrop, green screen, patio private access, studio operator, audio mixing, 4K camera, tripod, video editing)
Session: the recording date and time slot booked by the Member, including any Add-ons.
Rules: the rules governing your conduct as set out on our website.
London Creative Studios: Podcast & Photography studio at ICG House, Station Approach, Oldfield Lane North, Greenford, UB6 0AL.
Membership: your contractual relationship with us either as:
- Annual Membership: a membership option where the full Membership Fee is paid in monthly instalments and runs for a fixed term of 12 months.
- Bi-Annual Membership: a membership option where the full Membership Fee is paid in monthly instalments and runs for a fixed term of 6 months.
- Unlimited Membership: a membership option where the full Membership Fee is paid in monthly instalments and runs for a fixed term of 6 months. Sessions are restricted to 10am-6pm between Monday to Friday and are capped at 2hrs per booking.
- Rolling Membership: a membership option where the full Membership Fee is paid in monthly instalments and renews every month, cancel-able at anytime.
- Standard: a type of recording session where only microphones are provided and the full fee advertised is paid upfront.
- Professional: a type of recording session where microphones & 1 camera are provided and the full fee advertised is paid upfront.
- Commercial: a type of recording session where microphones & 2 cameras are provided and the full fee advertised is paid upfront.
Membership Fee: the amount you agree to pay upfront for your fixed term Membership.
Membership Amount: the amount you agree to pay on a monthly basis for your fixed-term membership, starting from £99 per month.
Cancellation Period: the first 14 days following the start of your Membership or the first 48 hours of booking a Session.
Promotional Rate: a discounted offer of our services and/or Membership available as a promotion for a limited amount of time.
Introduction
This is an Agreement between you (the Member), and London Creative Studios (the Studio), whose registered office is at ICG House, Station Approach, Oldfield Lane North, Greenford, UB6 0AL. (“The Studio”, “us” or “we”). By becoming a Member or booking a Session, you agree to our terms and conditions.
Starting Your Agreement
1. Our joining and booking process is an online process. Full membership prices and hourly rate options can be found on our website or quoted based on your requirements. By completing the online process and becoming a Member of London Creative Studios, you are accepting all the terms and conditions in this Agreement (insofar as they are applicable). You should only join if you have read them and accept them.
2. This Agreement starts once you have accepted the terms during the online process. By accepting the terms, you are agreeing to pay any applicable Membership Amount or booking fees. These are shown at the start of the online process and again before you confirm your payment instruction.
3. Your Agreement will start immediately from the date of your first Session. Your sessions must be booked using our online portal and will be limited to the hours booked. Any overtime beyond your booked session cannot be rolled over and will be charged in addition.
4. You agree to comply with the Rules and you agree to use the studio facilities and equipment in the proper manner. You must consult a member of staff if you are unsure. We are not liable for any injury you suffer through the incorrect use of our equipment or facilities.
5. You confirm that you are at least 18 years old.
6. You will be liable for any damage caused to our equipment or facilities through your negligent use.
7. You agree to tell us immediately of any changes to your personal details, including contact information.
Using The Studio
1. You are entitled to access and to use the studio defined by your Membership or Session until termination or suspension of that Membership or Session pursuant to this Agreement.
2. We will make reasonable endeavours to make available to you the rights and privileges of the studio you joined and have paid for. This includes access to the Studio and studio equipment, bathroom, staff and independent self-employed staff for general advice.
3. Use of the studio is on a self-service basis unless specified in an Add-on. We will make reasonable endeavours to advise you ways to best capture audio and video using our equipment, however we cannot be held liable for any technical issues that may arise during or after your Session.
4. We reserve the right to cancel your Session by providing at least 60 minutes written notice. In the event of a cancellation initiated by the Studio, we will issue you a refund in the amount of equal value to your booked Session.
5. We charge overtime for any Session recording beyond their booked slot, regardless of Membership status. Our overtime rate is charged per minute and is £0.95p for Standard, £1.30p Professional and £1.65 for the Commercial package.
6. Your media files will be delivered to you via a WeTransfer download link within 3 working days after your session. The link will be available to download for 28 calendar days, after which point they will expire. London Creative Studios, its parent companies, its agents, employees and subcontractors will not be liable for any lost media after this point.
7. You have the option to transfer your media files directly to a personal device after your Session. Should you opt for this, we can no longer back-up your media files.
Payment
1. If your Membership or Session has an initial fee, you agree to pay us the full amount inclusive of the Membership Fee by credit or debit card. You will be notified of any applicable Membership Fee during the online joining process, and this amount will be confirmed to you by email.
2. If your Membership has a recurring Membership Amount, you agree to maintain a Direct Debit instruction with your bank (or recurring international Credit Card payment for overseas members) for the Membership Amount. Your first monthly Membership Amount is due on or before the date of your first Session, and the subsequent monthly Membership Amount will be due on the same day of each month until your Membership is cancelled.
3. If the terms on which you are accepted as a Member include an initial Promotional Rate, you agree to pay the discounted Promotional Rate as a recurring Monthly Membership Amount during the introductory period specified in the promotional or introductory offer and that thereafter we may debit for the higher standard Monthly Membership Amount specified in the promotional offer (or such higher rate as might apply) in respect of each successive month after the introductory period has lapsed and unless or until your Membership is cancelled.
4. We reserve the right, at our discretion, to change your monthly Membership Amount or our studio rates. If this happens we’ll notify you not less than 1 weeks notice before the change is made. You are able to cancel your Membership or Session within this period, and if we do not hear from you within the period the new amount will apply automatically.
5. You agree to pay us the monthly Membership Amount or Session costs regardless of whether there is any temporary interruption in services during the period, foreseen or unforeseen. In circumstances where we are required to close or restrict facilities for any reason no refunds will be due. In the event the Studio services are interrupted, you have the right to cancel your Membership or Session.
6. If any payment due from you is returned unpaid or not honoured, you will pay us on demand an administration fee of £15.
Ending your Agreement
1. You have the right to cancel your Membership or Session within the Cancellation Period of the Agreement without giving any reason, but you must let us know you wish to do so within 48hrs of booking, 7 days from your Session or within 14-days for Memberships. You may email us at [email protected]
2. In case of dispute you must show that you cancelled the Agreement in accordance with the cancellation terms, but for these purposes it will be sufficient to show that you sent your communication concerning your exercise of the right to cancel before the cancellation period had expired.
3. If you have requested an immediate Membership start date or Session and you cancel your Membership within the cancellation period, proportionate charges will be due.
4. After the cancellation period, the Membership term will run thereof for a minimum of 1 month (Rolling Monthly), 6 months (Bi-Annual Membership) or 12 months (Annual Membership), depending on your Membership. The Session will run thereof for the duration of the Session booked.
No refunds will be given for unused billing periods; if you would like to continue using London Creative Studios until the end of your billing period please contact our member service team and we will re-instate your Membership at our discretion.
5. We reserve the right to terminate this Agreement and your Membership with immediate effect if you do not pay any applicable amount when it falls due.
6. We reserve the right to terminate this Agreement and cancel your Membership with immediate effect with written notice without reason. In this event you will no longer be able to access any of our facilities and we will provide you with a refund for any unused Sessions.
Other Clauses
1. Only you, the person or business named in the online process, can benefit from this Agreement.
2. If any of the terms of this Agreement are invalid, unenforceable or illegal the remaining terms can still be enforced.
3. London Creative Studios, its parent companies, its agents, employees and subcontractors are not liable for any loss, damage or theft of any of your property that you bring onto any of our premises. If such loss, damage or theft is caused by the negligent acts or omissions of London Creative Studios or its agents, employees or subcontractors, our liability to you will be limited to £100.
4. We may make reasonable changes to the London Creative Studios Membership Rules and the Membership Agreement at any time. It is your responsibility to check online at regular intervals for changes to these documents.
5. This Agreement is governed by the law of England and Wales.
6. You should print a copy of this Agreement for future reference.
By becoming a Member, you agree to have read and understood all the terms and conditions above.
